In today's Britain, public demonstration has ceased to be a fundamental right. Instead, it has become a privilege that authorities allow or withhold at their discretion. This represents the implication of new regulations that the current government is advancing, which would determine the timing and location protests can occur, with potential prison sentences for those who disobey these limitations.

Gradual Weakening of Democratic Rights

Previous administrations had already undermined this essential right: the previous Tory administration had granted law enforcement sweeping new authorities, which global rights bodies had condemned as "serious and undue limitations" on democratic freedoms. Taken together, these progressive assaults on liberty have effectively abolished the hard-won right to freedom of protest.

Exploiting Tragedy to Justify Crackdown

The most recent limitations are being defended by citing last week's heinous antisemitic assault on a British mosque. We can all agree on widespread consensus that the security of British Jews must be protected. However, employing this horrific incident as a pretext to stifle opposition is not only unrelated to that duty but perverts it.

"When you cannot set boundaries at genocide, you probably can't draw the line at democratic principles," commented a prominent American author, a statement that applies equally for the present administration.

Historical Context of Demonstration

Reflect on Britain's long tradition of protest and activism against racism and authoritarianism, from the historic 1936 Cable Street confrontation to postwar Jewish anti-fascist movements and the 1970s mobilizations against the far-right organization. Many of these historical demonstrators were branded as radicals in their era, even while they were fighting for the rights of minorities.

Present Situation

In the current complicated landscape, here's what's truly occurring: The Israeli government – a foreign state – is committing what United Nations investigations have described as systematic destruction. Its military actions have led the global justice body to issue legal indictments against Israel's prime minister and his former defense minister.

International popular sentiment has shifted dramatically against Israel's military campaign. In Britain, a large percentage of citizens believe Israel has likely committed war crimes. Most people would support a complete ban on weapons exports to the state, and approve the arrest of Netanyahu.

Silencing Dissent

Having essentially failed the argument, pro-Israel advocates are now exploiting a vile antisemitic crime to try to silence a mass movement against a ethical disaster. The British government seems involved in this effort. Ministers have failed to implement extensive restrictions on Israel and have allowed weapon shipments to continue.

People who are protesting against the destruction of Gaza have been labeled as hateful extremists. Yet there's a important factor why there hasn't been a broader suppression on these demonstrators until now: extremely few protesters have made truly offensive statements about Jewish people, giving police authorities little justification to take action.

Dangerous Conflation

Equating Jewish heritage with the policies of the Israeli state is not only manipulative but also harmful. The standard interpretation of antisemitism, adopted by the British government and numerous institutions, has been rightly challenged for potentially restricting legitimate criticism of Israel. However, there should be no disagreement about one of its central illustrations: that "holding Jewish people generally accountable for decisions of the state of Israel" constitutes antisemitism.

Escalating Restrictions

This is why we've arrived at a point where police authorities can suggest that protests criticizing Israel's policies should be called off because they might "inadvertently or intentionally" support anti-Jewish sentiment. Similarly, political figures have stated that acknowledgment of Palestinian statehood has made organizations "implicated" in supposed mistreatment experienced by Jewish communities.

Double Standards

On the same day as the religious center assault, the Israeli military killed numerous of Palestinian civilians in Gaza – increasing the terrible count from two years of ongoing violence that have claimed tens of thousands of lives. British politicians and news organizations have barely concealed the minimal importance they assign to Palestinian existence. This represents one of the boldest demonstrations of discrimination in our time.

Crossing Thresholds

Our government has already passed a dangerous threshold by proscribing Palestine Action, a peaceful, human rights-focused activist collective. Thousands of British protesters have been detained, primarily for carrying signs against genocide and supporting the banned organization. Many of those arrested are pensioners; including a retired priest and the daughter of a Holocaust survivor.

Global Comparisons

It's not difficult to see where this trajectory leads. In the United States, government officials helped demonize pro-Palestinian protests: a ex-political leader implied that some were "linked with" other nations, while the current president characterized such demonstrations as antisemitic. In doing so, they helped legitimize the authoritarian crackdown on such demonstrations – and on freedom of expression in general.

Looking Ahead

If a hard-right government comes to power, it would be given extensive authority to control opposition. What might a new administration do with this restrictive framework? Our forebears struggled, suffered and sacrificed their lives to establish our liberties. We may eventually rue how easily we permitted them to be eroded.
